Cape Travellers Guide is a platform that connects tourists with registered tour guides in the Western Cape Province, South Africa. We do not provide tour services directly - we facilitate connections between independent guides and travellers.

2. Platform Role & Limitations

2.1 What We Do
  • Provide a directory of registered tour guides
  • Facilitate initial contact between tourists and guides
  • Display guide profiles, tour offerings, and contact information
  • Send automated communication for enquiry confirmations and feedback collection
2.2 What We Do NOT Do
  • Arrange, organize, or provide tour services
  • Handle payments between guides and tourists
  • Guarantee availability, quality, or safety of tours
  • Act as an employer, agent, or representative of any guide
  • Provide travel insurance or assume liability for tour activities

3. Tour Booking Process

How It Works
  1. Browse Guides: Tourists can search and view guide profiles on our Platform
  2. Submit Enquiry: Use our enquiry form to contact a guide about a specific tour
  3. Direct Communication: The guide will contact you directly via email to discuss details
  4. Arrange Privately: All tour arrangements, pricing, and payments are handled directly between you and the guide
Important: Cape Travellers Guide is not a party to any agreement between tourists and guides. Any contract for tour services is between you and the guide directly.

4. Payments, Deposits & Refunds

4.1 Payment Terms
  • All payments for tours are made directly to the guide
  • Payment methods, amounts, and timing are agreed between you and your guide
  • Cape Travellers Guide does not process, handle, or hold any tour payments
4.2 Deposits
  • Guides may request deposits to secure bookings
  • Deposit amounts and terms are set by individual guides
  • We recommend getting deposit terms in writing before payment
4.3 Refund Policy
Cape Travellers Guide does not handle refunds. All refund requests must be directed to the guide who received your payment. Each guide has their own cancellation and refund policy - please discuss these terms before booking.

Contact the guide directly to arrange a refund or alternative date. If you cannot resolve the issue, you may contact us at capetravellersguideapp@gmail.com and we will attempt to mediate, though we cannot guarantee any specific outcome.

5. Guide Responsibilities

Registered guides on our Platform agree to:

  • Hold valid CTGA (Cape Tour Guides Association) registration
  • Provide accurate information in their profiles
  • Respond to enquiries in a timely and professional manner
  • Deliver tours as described and agreed with tourists
  • Maintain appropriate insurance coverage for their activities
  • Comply with all applicable laws and regulations

6. Tourist Responsibilities

As a tourist using our Platform, you agree to:

  • Provide accurate contact information when submitting enquiries
  • Communicate respectfully with guides
  • Honor bookings and payment agreements made with guides
  • Arrive on time for scheduled tours
  • Follow safety instructions provided by guides
  • Obtain appropriate travel insurance for your trip

7. Liability & Disclaimers

7.1 No Guarantee

We do not guarantee the quality, safety, legality, or availability of any guide or tour listed on our Platform. Guides operate as independent contractors, not as employees or agents of Cape Travellers Guide.

7.2 Limitation of Liability

To the maximum extent permitted by law, Cape Travellers Guide shall not be liable for:

  • Any injuries, accidents, or property damage occurring during tours
  • Any financial loss arising from transactions between tourists and guides
  • Any disputes between tourists and guides
  • Any acts, omissions, or misconduct of guides
  • Cancellations, delays, or changes to tours
7.3 Your Responsibility

You acknowledge that you use our Platform and engage with guides at your own risk. We strongly recommend:

  • Obtaining comprehensive travel insurance
  • Researching guides before booking
  • Discussing safety measures with your guide
  • Getting all agreements in writing

8. Intellectual Property

All content on this Platform, including text, graphics, logos, images, and software, is the property of Cape Travellers Guide or its content suppliers and is protected by copyright laws. You may not reproduce, distribute, or create derivative works without our express written permission.

Guide profile content and images remain the property of the respective guides who uploaded them.

9. Privacy & Data Protection

Your use of our Platform is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information in compliance with GDPR and POPIA (Protection of Personal Information Act, South Africa).

10. Termination

We reserve the right to:

  • Remove any guide from the Platform at our discretion
  • Block users who violate these Terms
  • Discontinue the Platform at any time

Guides may request removal of their profile at any time by contacting us.

11. Governing Law & Disputes

These Terms are governed by the laws of the Republic of South Africa. Any disputes arising from your use of our Platform shall be subject to the exclusive jurisdiction of the courts of the Western Cape Province, South Africa.

12. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via our website. Your continued use of the Platform after changes constitutes acceptance of the updated Terms.

Yes, we strongly recommend comprehensive travel insurance that covers adventure activities, medical emergencies, and trip cancellation. Neither Cape Travellers Guide nor individual guides are responsible for providing insurance coverage.
